So, I always have a problem finding this document online, even though it is posted for free to download and share. Therefore, I am re-posting it here on my blog for others to access.

The FOIA and how to use it to your advantage
I posted this on Facebook in response to a fellow researcher's question about it, but I thought that I should probably post it here too, that it may be beneficial for others who are searching and need to know what they can do to assist themselves and others.
In this case, a woman in her late 30's is looking for her birth mother, but she is hitting many brick walls, and she feels that the records are out there some where, and she was not sure how to go about having the records produced for her.
She knows her birth name (first and middle, not sure about last), what time she was born, what day she was born, and she knows she was immediately given up for adoption.
Normally, when adoptions happen, the adoption agency must release the records of the person's birth once the person reaches the age of maturity, normally between the ages of 18 and 21. This woman is now in her late 30's, and she STILL does not know who her birth parents were! To have been searching for her own personal truth for so long...my heart goes out to her...I sincerely hope that my response helps...

The FOIA can be used for darn near anything now. It's a really great "tool to keep in your back pocket", your "ace in the hole", so to speak...
Here is the link to the FOIA form: http://www.uscis.gov/files/form/g-639.pdf
In part 1, you will need to make sure the Privacy Act (PA) area is checked, that you are requesting your own records.
In part 2, you will need to check Other and specify what records you want released under the FOIA (example: "Complete and unabridged birth records, and all records relating to birth parents obtained by the hospital in connection with the event of my birth")
In part 3, obviously you would check All My Records, etc etc etc....
Just make sure to fill out all the parts that you can and make sure to fill in all the required information and they cannot ignore the request for information regarding births, especially if there are certain circumstances involved.

The Freedom of Information Act has been used by people around the country for a myriad of reasons, from people in Phoenix, AZ, sending FOIA documents to the government for full disclosure of the "Phoenix Lights", to information about Area 51/Roswell, NM's, "weather balloon experiment", to people requesting immigration status of a someone...it's amazing how much information you can actually get from people or companies just by mentioning the FOIA! For example, I used it to obtain records from funeral homes a number of times, when they were going to give me a hard time for requesting any documentation they had on my family. As soon as the FOIA was mentioned (long name, not short), they seemed to want to cooperate quickly with me...I like it when that happens...lol...

Some circumstances over ride HIPAA and the Privacy Act (the Patriot Act, for one, but we'll not go there just now)...there could concerns about family medical conditions, which would severely limit or possibly impede the quality of life for that woman and any children she had (such as a family history of cystic fibrosis, cancer, epilepsy, etc.), which if brought to the attention of the courts, normally has the judge issuing the warrant for release and disclosure of documentation ASAP, especially when -- if a child is put up for adoption -- he or she has the right to have their birth parent's information revealed to them upon their state's age of maturity (usually between 18 and 21, but I know someone who had fought from the time she was 18 until the time she turned 28 to get her birth parent's information -- that person was my half sister)...depending on the state, you may need to check their FOIA policy because Federal FOIA may not prevail over the state's if the state's FOIA policy or form is more strict or stringent...
To cut to the chase, there are certain FOIA papers which a person can use before they go to a court house and obtain a subpoena for documents -- or "subpoena duces tecum".

Remember when submitting FOIA's for hospital records, court records, etc., it is best to have printed at least 3 copies and make sure to have the one that you are delivering to the place of records notarized and sent via some method that requires a signature confirmation of delivery (USPS Certified Mail, UPS, FedEx, etc.). You will want to make sure you receive confirmation that the documents have been delivered and verification of the accepting person's signature, so if you need to go back and say "yes, you did receive that on Tuesday, May 5th, 2020 at 2:20 pm EST; it was signed for by Miss Jones", etc., you can...
Accompanying your official form, you will want to make sure you write a formal letter (should also be notarized) stating your name, the purpose of this letter and the FOIA and give them a reasonable time frame in which to produce documents (anywhere from 30 to 90 days) before you are forced to pursue a subpoena for them to produce documents (FYI, anyone can file a subpoena for nearly anything within the bounds of the law, and all you need to do is pay the filing fee and the fee for the process server and you are done). Make sure to leave your contact information, cell phone, physical address, etc etc etc in the letter as well, so that if there are any questions or hiccups along the way that they should be able to call you.

Networked Blogs
So I just set up my Networked Blogs links and will be working on the website revisions tonight.
As I had wanted to do, I had posted the Zangari Genealogy website on November 3rd, but abruptly took it down after having it online for 5 minutes. It did not work as well online as it did locally, nor did it display correctly, so I took it down immediately. Currently, there is only a few place holder pages available, but I hope to rectify that soon.
I have begun the painful process of revamping the site once more, but after creating half of the site all over from scratch I am once more unimpressed with the results. Here is a screen shot of the current site which I am not happy with...
The page and the site are looking good, but looks don't count for everything. I am fighting with the presentation of the page width and having the page auto adjust using this style and page layout. And while I like how this page is progressing, the same cannot be said (unfortunately) for all the other connected pages and sub-pages. If you look at the title of the above page's screen shot you will see it reads "Family Information". While this is great, it does not suffice for my needs or desires.
I will be renovating the site for a few weeks once more, and hopefully by then I can reupload the site and be completely happy with the results. In the mean time, I hope everyone who stops by to have a read will also take the time to press that little button to the right that allows you to follow this blog or join this site.

I've been thinking of my deceased step daughter Ariel today...
Does anyone else remember the movie The Abyss? In that movie, the divers were using liquid oxygen to breathe under water.
I just had a strange flashback to that movie while watching House, season 8, episode 2: "Transplant", where a woman was in need of a double lung transplant, and House had to cure a set of lungs of excessive smoke inhalation which were organ donated by a boy in his late teens or early twenties upon his death.
I often wonder how far medical science has progressed and if we have that ability yet, the ability to create liquid oxygen which can be used for breathing, which could also possibly be used for treating lung problems, by mixing medicines into the liquid oxygen.
I wonder how feasible it would be to counteract -- not necessarily cure -- lung diseases like Cystic Fibrosis by using liquid oxygen to clean the lungs once per month of all the mucus so that the airways in the body do not get clogged.
I have also been wondering if it would just be possible to remove the mucus glands and stop the body from producing mucus, and if that would further cause harm or if it would help resolve the issue, or if the disease would just manifest itself in another form afterwards, to compensate for the loss of a way to escape the body. Maybe it would change to feces backing up in the body, which would create sepsis or worse...I don't know, I am not a doctor, but I am someone whose mind thinks outside the box all too frequently....
Anyway, I have done a lot of reading on CF over the last 6 or 7, although I had stopped reading after her death this past June, I think I still want to read more though...any awareness that I can create for others as well as for myself would still be beneficial...
I think I am going to see about doing the walk for a cure that my ex wife used to do every year....I think finding sponsors to help with the walk and to help raise funds would be the best way to go...maybe find some corporate sponsorship for the walk to help raise money and awareness some how....
We all feel a tad bit Lilliputian on the grander scale when we think of death and all the medical issues which we do not have cures for, such as Aids, Cancer, Epilepsy, Cystic Fibrosis, Diabetes, etc., especially when we see people dying around us and on TV all the time...
I think I need to end this here...I will revisit this another time....

Family Tree Maker CDs / Family Archive CDs & Miscellaneous Genealogy Software

I found an all most complete list of Family Tree Maker CDs / Family Archive CDs on THIS SITE, and I loved how comprehensive this list was. I also liked the spreadsheet formatting on this. I am going to have to go through and highlight which ones I have all ready and then add those which are not listed here, to make a more updated version of what I created back in July of this year.
I will eventually own the complete set, and by then I hope to have my other project (creating another viewer for these file types) completed.
I have some really good people and really good friends who have been working with me, and I want them to know their help and guidance is always much appreciated.
For the last 6 months I have been working on a research project; a report that details what steps I have gone through and which software I have used.
I am in hopes that when the project completes, I have a totally accessible database software, based on SQL, which will access the data on these CDs. I hope to release some really good news by the end of July 2013.
Much more research is needed previous to me saying anything further, but suffice to say that as a Genealogist I am excited at the prospects and thoughts of what is possible...
In any event, all the items which I have highlighted in yellow below are software titles and supportive data which I currently have on hand and/or installed...
